When are attorney's fees due in a lawsuit, and what are the criteria followed in their assessment?

Attorney's fees are due to the party who was compelled to resort to litigation to recover their right due to the other party's undue delay or actions necessitating the lawsuit. This is in application of the principle of justice and in accordance with the sayings of the Prophet (peace be upon him): "The delay by a wealthy person (in fulfilling an obligation) is injustice" and "There shall be no harm nor reciprocating harm." The compensation for attorney's fees is assessed by considering several factors, including the extent of the damage, the nature of the lawsuit, the effort expended, and the customary fee (Ajrat Al-Mithl), bearing in mind that the assessment is subject to the discretionary power of the court.
