What is the judicial ruling in a commercial lawsuit when it is proven that one of the parties does not possess the status of a merchant?

If it is proven that one of the parties does not possess the status of a merchant, the Commercial Court rules that it lacks subject-matter jurisdiction, and jurisdiction is vested in the General Courts, in accordance with paragraph (1) of Article (76) of the Law of Sharia Procedure, Article (16) of the Commercial Courts Law, and the Memorandum of Delimitation of Jurisdiction between the General and Commercial Courts.
