What are the regulations and conditions for entitlement to compensation for litigation expenses (legal fees)?

Compensation for litigation expenses (legal fees) is not due unless the three elements of compensation are proven to be met, namely: fault, damage, and causal link. Furthermore, compensation for litigation expenses is only awarded if the other party was unjust and frivolous in their claim, knew that the right was with their opponent, and initiated the litigation maliciously or out of greed for an undue right. The request is rejected if the element of fault is not proven, or if it is not proven that the other party was unjust or frivolous, or if the right was ambiguous and not evident.
